Gratuity is calculated strictly on the last basic salary. Allowances such as housing, transport, education and bonuses are excluded by law.
21 days of basic pay for each of the first five years of service, and 30 days of basic pay for each year thereafter. Total gratuity is capped at two years of basic pay.
Yes. You must have completed at least one full year of continuous service with the employer to be entitled to gratuity.
Yes. Under Federal Decree-Law No. 33 of 2021 (effective 2022), the distinction between limited and unlimited contracts was removed and gratuity is now calculated the same way regardless of contract type.
Yes. Any period of unpaid leave is not counted toward the length of service used to calculate your gratuity.
No. The employer must pay the end-of-service gratuity within 14 days of the employment ending. You may file a complaint with MOHRE if this is delayed.
